Would the current members get the vote, or would the members who win the November election once sworn in get it? If Democrats take back the House and Republicans the Senate, Harris-Vance would be chosen on a party-line vote.
Finally, if the utilization of the 12th amendment was to be enacted, does the current Vice President (Harris) still have to certify the vote/election on Jan 6th?
Additionally, does the Senate have to choose the VP candidate for that position or can they choose either the presidential candidate or anyone else not on the ticket however in their party?
If this was to happen and there was a “resistance VP” in a second Trump Administration, wouldn't Senate Democrats want to elect Harris, not Walz? It seems like the top of the Democratic ticket would be a more shrewd choice to have running interference in the White House, especially since there are no term limits on how long one can serve as VP. This would also set up Harris to run again in 2028 as the Democratic nominee.

That’s a great question, I was thinking the same thing ….the Senate would want to keep Harris as VP
Great explanation but don't want to go there.
